Participant Registration Terms, Conditions, Waiver, and Release of Liability

IMPORTANT NOTICE TO PARENT OR LEGAL GUARDIAN: THIS DOCUMENT CONTAINS A RELEASE OF LIABILITY, ASSUMPTION OF RISK, INDEMNIFICATION AGREEMENT, AND BINDING ARBITRATION CLAUSE. BY COMPLETING REGISTRATION, YOU ARE AGREEING ON BEHALF OF YOURSELF AND YOUR MINOR CHILD TO ALL TERMS CONTAINED HEREIN. PLEASE READ CAREFULLY BEFORE SIGNING.

1. Parties and Definitions

These Terms and Conditions ("Agreement") are entered into between Relief Alliance, Inc. ("Relief Alliance," "League Operator," "we," "us," or "our"), a Florida nonprofit corporation (EIN: 99-5000564), and the parent or legal guardian ("Parent/Guardian") registering a minor participant ("Participant") in the Florida Youth Pickleball League ("League" or "FYPL"). The League is operated by Relief Alliance in partnership with the National Pickleball Association. "Participant" refers to the minor child being registered. "Registrant" refers to the Parent/Guardian completing registration.

2. Eligibility Requirements

Participation in the Florida Youth Pickleball League is open to youth between the ages of 8 and 18 years of age as of the first day of the applicable season. Participants must: (a) complete all required registration forms and provide accurate information; (b) pay all applicable registration fees in full prior to participation; (c) obtain clearance from a licensed physician or healthcare provider if required by Relief Alliance; and (d) comply with all League rules, codes of conduct, and safety protocols as established and amended by Relief Alliance from time to time.

3. Registration Fees and What Is Included

Registration fees are established by Relief Alliance and are subject to change at Relief Alliance’s sole discretion with reasonable notice. The registration fee covers: League uniform; equipment usage during League activities (equipment remains the property of Relief Alliance or its designees); League registration and administrative processing; and a contribution toward League operational expenses. Registration fees do not cover personal protective equipment, transportation, or any other costs not expressly listed above.

ALL REGISTRATION FEES ARE NON-REFUNDABLE AND NON-TRANSFERABLE except as required by applicable law. In the event a season is cancelled due to circumstances beyond Relief Alliance’s reasonable control (including but not limited to natural disasters, public health emergencies, or governmental orders), Relief Alliance may, at its sole discretion, offer a credit toward a future season but is not obligated to provide a monetary refund.

4. Assumption of Risk

Parent/Guardian acknowledges that participation in pickleball and related athletic activities involves inherent risks of physical injury, including but not limited to: sprains, strains, fractures, contusions, concussions, heat-related illness, and other acute or chronic injuries. Parent/Guardian, on behalf of themselves and Participant, voluntarily and knowingly assumes all risks associated with Participant’s participation in the League, whether such risks are known or unknown, foreseen or unforeseen.

5. Release and Waiver of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, PARENT/GUARDIAN, ON BEHALF OF THEMSELVES, PARTICIPANT, AND THEIR RESPECTIVE HEIRS, EXECUTORS, ADMINISTRATORS, AND ASSIGNS, HEREBY RELEASES, WAIVES, DISCHARGES, AND COVENANTS NOT TO SUE RELIEF ALLIANCE, INC., THE NATIONAL PICKLEBALL ASSOCIATION, THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, COACHES, VOLUNTEERS, SPONSORS, FACILITY OWNERS, AND SUCCESSORS (COLLECTIVELY, "RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, ACTIONS, AND CAUSES OF ACTION OF ANY KIND, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, ARISING OUT OF OR RELATED TO PARTICIPANT’S PARTICIPATION IN THE LEAGUE, INCLUDING BUT NOT LIMITED TO PERSONAL INJURY, PROPERTY DAMAGE, OR DEATH.

THIS RELEASE IS INTENDED TO BE AS BROAD AND INCLUSIVE AS PERMITTED BY THE LAWS OF THE STATE OF FLORIDA AND SHALL BE BINDING UPON PARENT/GUARDIAN AND PARTICIPANT TO THE MAXIMUM EXTENT ALLOWED BY LAW.

6. Indemnification

Parent/Guardian agrees to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, damages, losses, costs, and expenses (including reasonable attorneys’ fees) arising from: (a) Participant’s participation in the League; (b) any breach of this Agreement by Parent/Guardian or Participant; (c) any negligent or intentional act or omission by Parent/Guardian or Participant; or (d) any claim by a third party arising from Participant’s conduct during League activities.

7. Medical Authorization and Emergency Treatment

Parent/Guardian authorizes Relief Alliance and its designated personnel to seek and consent to emergency medical treatment for Participant in the event that Parent/Guardian cannot be reached in a timely manner. Parent/Guardian agrees to maintain current and accurate emergency contact information with Relief Alliance at all times. Parent/Guardian acknowledges that Relief Alliance does not provide medical insurance coverage for Participants and that Parent/Guardian is solely responsible for all medical costs incurred by Participant.

8. Code of Conduct and Disciplinary Procedures

All Participants and Parent/Guardians are expected to conduct themselves with sportsmanship, respect, and integrity at all times. Relief Alliance reserves the right to suspend or permanently remove any Participant from the League for violations of the Code of Conduct, including but not limited to: unsportsmanlike behavior; harassment or bullying of other participants, coaches, or officials; physical altercations; possession or use of prohibited substances; or any conduct deemed detrimental to the League or Relief Alliance. No refund of registration fees will be provided in the event of suspension or removal for conduct violations.

9. Photography, Video, and Media Consent

By registering for the League, Parent/Guardian grants Relief Alliance and the National Pickleball Association a perpetual, irrevocable, royalty-free, worldwide license to photograph, film, record, and use Participant’s name, image, likeness, and voice in connection with League promotional, educational, and fundraising materials, including website content, social media, print publications, and broadcast media, without further compensation or approval. Parent/Guardian may opt out of media use by submitting a written request to info@reliefalliance.org prior to the start of the season.

10. Supervision and Safeguarding of Minors

Relief Alliance is committed to the safety and well-being of all Participants. All coaches, volunteers, and staff who interact directly with Participants are required to complete background screening prior to participation. Relief Alliance maintains and enforces a Safeguarding Policy and a two-adult rule for interactions with Minors. Parent/Guardian is responsible for ensuring that Participant is supervised during all non-League activities, including before and after League events. Relief Alliance is not responsible for the supervision of Participants outside of scheduled League activities.

11. Equipment Policy

Equipment provided by Relief Alliance for use during League activities remains the property of Relief Alliance or its designees. Participants are responsible for the reasonable care of all equipment. Parent/Guardian agrees to reimburse Relief Alliance for the cost of any equipment damaged or lost due to Participant’s negligence or intentional misconduct. Participants may use their own personal equipment subject to approval by League officials.

12. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Florida. Any dispute arising under or related to this Agreement shall be resolved through binding arbitration in Orange County, Florida, administered by the American Arbitration Association. Parent/Guardian waives any right to a jury trial and any right to participate in a class action proceeding against the Released Parties.

13. Severability and Entire Agreement

If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. This Agreement constitutes the entire agreement between the parties regarding Participant’s participation in the League and supersedes all prior representations, understandings, and agreements.
